1. Who you are buying from
Adelaide Cut Cabinets is a trading name of Danil Naumov, sole trader, ABN 53 489 715 992, registered for GST. Workshop: 58 Carlisle Street, Camden Park SA. E-mail: danilnaumov9@gmail.com.
Your contract is with Danil Naumov, and your tax invoice will be issued by Danil Naumov (trading as Adelaide Cut Cabinets). "We", "us" and "our" in these terms mean Danil Naumov.
2. Orders and prices
- The price shown by the calculator is a quote. All prices are in Australian dollars and include GST.
- When you send an order we check it and e-mail you a tax invoice. If we find an obvious error in the order or in the calculated price, or if we cannot make something as ordered, we will tell you before you pay and you can change or cancel the order.
- The contract starts when you pay the invoice. We may decline an order for a good reason, in which case we will tell you and refund anything you have paid.
- The 3D preview, drawings and cut list are a guide to help you check your order. The finished goods follow the sizes and options in the order.
3. Your measurements
- Everything is made to measure, exactly to the sizes you enter. Sizes are carcass sizes in millimetres and do not include doors, drawer fronts, handles, kickboards or benchtops.
- You are responsible for measuring your space and for checking that the sizes, the number of items and the options (doors, drawers, legs, fixing type and so on) are right, including clearances for walls, appliances, plumbing and openings.
- If the goods are made as ordered but do not fit because of the measurements or options you chose, that is not a fault. We are happy to make replacement parts as a new order.
4. Payment
- Orders are paid in full before production starts, by the payment method shown on the invoice.
- Production is booked when the payment has cleared. If an invoice is not paid within its due date we may cancel the order.
5. Lead times
The lead time shown on the site is an estimate based on our current queue, counted in working days from payment. We do our best to meet it but it is not guaranteed. We will e-mail you when your order is ready and let you know as soon as possible about any delay.
Subject to section 9, we are not liable for any delays caused by circumstances beyond our reasonable control, including machinery breakdowns, material supply shortages, or power outages.
6. Pickup, risk and ownership
- Orders are collected from our workshop at 58 Carlisle Street, Camden Park, by appointment once we tell you the order is ready. We do not deliver.
- Please bring a suitable vehicle, straps and protection, and enough people to load safely. While we may assist with loading as a courtesy, the ultimate responsibility for securing and safely loading the goods rests entirely with you.
- Risk of loss or damage passes to you when the goods are collected. Ownership passes to you when the order has been paid in full.
7. Storage of uncollected orders
- We store a finished order free of charge for 14 days from the day we tell you it is ready.
- After that we may charge a reasonable storage fee. We will tell you the fee in writing before it starts.
- If an order is still not collected and we cannot reach you after reasonable attempts, we may deal with the goods as the law allows for uncollected goods.
8. Changes and cancellation
- You can change or cancel an order free of charge before production starts (status "Received" or "Paid" under My orders). If you have already paid, we refund the full amount.
- Once the status is "In production", the order cannot be changed or cancelled, because the parts are cut to your sizes and cannot be sold to anyone else.
- Because the goods are made to your specifications, we do not offer refunds or exchanges for change of mind or for measurements or options chosen by you. This does not affect your rights under the Australian Consumer Law (section 9).
9. Your rights under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. We do not give any extra warranty beyond these rights.
10. Checking goods and reporting faults
- Please check the goods when you collect them, and tell us about any missing or damaged parts as soon as you can, ideally before you start assembly, with photos and your order number.
- Board is cut on a CNC machine to tolerances not exceeding ±1 mm. Slight differences in the colour or texture of board and edging between batches are normal and are not a fault.
- Damage caused after collection (for example in transport, by incorrect assembly or installation, by water or moisture, or by misuse) is not a fault in the goods.
11. Assembly and installation
- Flat-pack orders are assembled by you or your installer. Hardware we supply is listed in your order; wall fixings suited to your wall are not included.
- Cabinets must be fixed to the wall or to each other as needed so they cannot tip over. Tall cabinets must always be secured to the wall.
- We are not responsible for installation work done by others, or for benchtops, appliances, plumbing or electrical work.
12. Our liability
To the extent the law allows, and subject to section 9, our liability for goods that are not of acceptable quality is limited to replacing or repairing them, or refunding what you paid for them, and we are not liable for indirect or consequential loss such as loss of profit or the cost of delays to other trades. If you are a consumer under the Australian Consumer Law, this limit applies only where the law allows it.
13. Privacy, law and changes
- We handle your personal information as described in our Privacy Policy.
- These terms are governed by the laws of South Australia.
- We may update these terms from time to time. The version you accepted when you sent your order applies to that order; it is recorded with the order.
